Terms & Conditions Agreement

This Terms & Conditions Agreement (“Agreement”) is a legal agreement between you (“User”) and AppBytes, LLC (“Company”), the developer of the EV Companion mobile application (“App”). By using the App, you agree to be bound by the terms and conditions outlined in this Agreement.

1. User Accounts

a. User Accounts: Users may create accounts within the App to access additional features and personalized services. You are responsible for maintaining to what degree you desire the confidentiality of your account information to be, and for all activities that occur under your account.

b. User-Generated Content: The App allows users to create text content. By using the App, you acknowledge and agree that any content you create, including but not limited to comments, feedback, suggestions, or other materials, shall be considered non-confidential and non-proprietary. The Company shall have the right to use, reproduce, modify, distribute, and display such content without any obligation of compensation or credits.

c. Infringement Notices: If you believe that any content within the App infringes upon your intellectual property rights, please notify us at info@appbytes.net. We will promptly address and investigate such notices.

2. Subscriptions

a. Subscription Tiers: The App offers three subscription tiers, each with its own features and benefits. Subscription fees and trial terms are clearly specified within the App. By subscribing to a specific tier, you agree to pay the applicable fees associated with that tier.

b. Free Trial: Certain subscription tiers may include a free trial period. You are responsible for canceling your subscription before the end of the trial period to avoid being charged.

c. Payment and Billing: Subscription fees will be charged through your designated payment method as set in your own Apply Pay preferences. We do not process any payments, cancellations, or refunds directly.

d. Subscription Cancellation: You may cancel your subscription at any time through your device’s “Settings” app. Please note that cancellation does not entitle you to a refund for any unused portion of the subscription.

3. Contact Information

a. User Support: If you have any questions, inquiries, or need assistance regarding the App, you can contact the Company’s customer support team by email at info@appbytes.net or by visiting appbytes.net.

b. Communications: By using the App, you consent to receive communications, including promotional messages, notifications, and updates, from the Company via email or other means of contact you have provided.

4. Intellectual Property

a. Ownership: All content, trademarks, logos, and intellectual property rights associated with the App, including the name “EV Companion” and “AppBytes, LLC,” are the exclusive property of the Company and its licensors. You acknowledge and agree not to use, modify, reproduce, distribute, or create derivative works based on the Company’s intellectual property without prior written consent.

b. Third-Party References: The App may display logos, trademarks, or other information belonging to external companies or third parties. The inclusion of such references does not imply endorsement or ownership by the Company.

5. Disclaimer of Liability

a. Informational Services: The App provides informational services regarding electric vehicle charging stations, trip planning, and related information. The Company does not provide any guarantees or warranties regarding the accuracy, completeness, or reliability of the information presented within the App.

b. User Responsibility: It is the User’s responsibility to ensure they are aware of their own unique vehicle’s ranges, capabilities, and charging requirements. The Company is not liable for any unforeseen complications, incomplete trips, or dangerous situations that may arise from the use of the App.

c. Safety Precautions: Users should exercise caution and use their own judgment when relying on the App’s information. The Company recommends verifying charging station availability, pricing, and access details directly with the charging network or station operator.

6. Governing Law

a. Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the state of Tennessee, United States, without regard to its conflict of laws principles.

b. Dispute Resolution: Any disputes arising out of or related to this Agreement shall be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association.

By using the EV Companion App, you acknowledge that you have read, understood, and agreed to be bound by the terms and conditions of this Agreement.
